Alberto Fernández quiere que los mandatarios ayuden a evitar abusos de comercios y empresas. Estarán habilitados para hacer multas y clausurar comercios.
El Presidente firmará hoy martes el decreto de necesidad y urgencia con el que se propone otorgar el «poder de policía de fiscalización» a los gobernadores e intendentes a controlar precios, en medio de la crisis por el impacto en la economía que genera la cuarentena obligatoria dispuesta para paliar el avance del coronavirus.
Así lo confirmaron altas fuentes oficiales, luego de algunas demoras tras el anuncio que hizo el propio Alberto Fernández el domingo. El decreto saldrá en el Boletín Oficial.
Tras la confirmación de Fernández, el Gobierno afinó la letra del decreto que le otorgará a los mandatarios la posibilidad de multar y clausurar comercios, que prevé la ley 20.680, de Abastecimiento; y hoy es potestad del Ejecutivo nacional.
El ministro de Desarrollo Productivo, Matías Kulfas; y la secretaria de Comercio Interior, Paula Español; trabajaron contrarreloj en la letra del decreto, ante el pedido del jefe de Estado de que se tomen medidas inmediatas para evitar abusos de comercios y empresas.
El texto consensuado, extiende las facultades de control a «gobernadores en coordinación con las autoridades municipales», que de esta manera tendrán la posibilidad de hacer «ejercicio del poder de policía de fiscalización sobre los precios máximos fijados» por el Gobierno.
Entre otras sanciones, la ley 20.680 prevé la posibilidad de aplicar multas de 500 pesos a 10 millones de pesos, el decomiso de mercadería, la clausura de un comercio por 90 días, la inhabilitación de hasta cinco años para ejercer el comercio y el mismo plazo para ser proveedor del Estado.
El decreto no deja dudas de que ahora los mandatarios locales podrán fiscalizar de que se cumpla con la ley.
No obstante, la Secretaría de Comercio Interior será garante del procedimiento y evaluará las actuaciones administrativas que lleven a eventuales sanciones, de manera tal de evitar abusos a los que se expone el Gobierno al abrir el juego a centenares de dirigentes a lo largo de todo el país.
Los intendentes consultados se mostraron conformes con la decisión de Fernández, quien les había adelantado, ni bien arrancó la cuarentena, su intención de ponerlos a controlar precios.
Fue en el encuentro que mantuvo con jefes comunales del conurbano bonaerense en Olivos. Allí, tras escuchar el reclamo de varios de ellos por la suba de precios en los comercios más chicos de sus municipios, Alberto F. les propuso sumarse a los controles que hace Comercio Interior.
«Está muy bien la medida. Va a servir para que los que se quieran aprovechar, tengan más cuidado porque van a tener una referencia cercana controlándolos», dijo un alcalde peronista de un populoso distrito de la provincia de Buenos Aires.
En este tema parece no haber grieta, porque entre los intendentes de Cambiemos también hay aprobación hacia la herramienta de control. «Tenemos la estructura preparada para salir a controlar, vamos a colaborar», remarcó uno de ellos.
Para Alberto F., el rol de los intendentes será claven las productoras de alimentos ni en los grandes supermercados, sino en los distribuidores y negocios de cercanía».
